How does it work in Spain?

Tenders are regulated by Law 9/2017 on Public Sector Contracts, which adapts European directives on public procurement.

The process is divided into several stages:

  1. Preparation of the file: drafting of technical and administrative specifications.
  2. Publication: announcement on official platforms such as the Public Sector Contracting Platform.
  3. Submission of offers: companies submit their proposals within the deadline.
  4. Evaluation and award: technical and financial analysis of the offers.
  5. Formalization: signing and execution of the contract.

Types of procedures

    • Open: any company can participate.
    • Restricted: only pre-selected companies may submit bids.
    • Negotiated: negotiation takes place directly with one or more suppliers.

 

  • Competitive dialogue: ideal for complex contracts, with prior dialogue between the administration and bidders.
